Terms of service

These terms cover use of the Orator CRM software. A campaign’s written licensing agreement with CDServices, LLC, where one exists, takes precedence over anything here that conflicts with it.

The agreement

Orator CRM is provided by CDServices, LLC, a Texas limited liability company. By using the software you agree to these terms. If you are using it on behalf of a campaign, you confirm you are authorised to accept them for that campaign.

Accounts

Accounts are issued by a campaign to its own staff and volunteers. You are responsible for activity under your account and for keeping your credentials secure. Do not share a login.

Data we provide to you

Where we supply voter data or other datasets, that data is licensed to you, not sold, for the campaign, race, or jurisdiction identified in your order and for the term of your agreement.

You may not use it for any other campaign, committee, candidate, or jurisdiction; you may not resell, sublicense, publish, or otherwise redistribute it, in whole or in part; and you may not retain it after your agreement ends. Access licensed for one race does not extend to another, and a licence covering a jurisdiction does not entitle you to run separate campaigns beneath it unless your order says so.

Data we license to you may itself be licensed to us by a third party, and your use of it is subject to those upstream terms.

Data you provide and generate

Client Data means the records you supply and everything your canvassers record through Orator CRM. You keep ownership of Client Data.

You grant CDServices, LLC a perpetual, irrevocable, worldwide, non-exclusive, royalty-free licence to host, store, process, analyse, and otherwise use Client Data in connection with operating, supporting, and improving Orator CRM and the records it maintains. This licence continues after your access ends.

Your responsibilities for the data you provide

You represent and warrant that you have all rights, consents, and authority necessary to provide Client Data and to grant the licence above, and that doing so does not breach any law or any agreement binding on you.

Voter registration data specifically. Voter files obtained from a state or county are commonly issued subject to an affidavit or licence restricting how they may be used. In Texas it is a criminal offence to use voter registration list information to advertise or promote commercial products or services. You are responsible for ensuring that providing your file to us, and our use of it under the licence above, is consistent with the terms under which you obtained it. If it is not, do not upload it.

You are also responsible for complying with the election, privacy, and calling or contact laws that apply in your jurisdiction.

Acceptable use

Do not attempt to access another campaign’s data.
Do not falsify field records. Fabricated canvassing data undermines the product’s purpose and may end your access.
Do not use the software to harass anyone, or to contact people who have asked not to be contacted.
Do not probe, scrape, or attempt to circumvent the security of the service.

Availability

We work to keep the service available and will give notice of planned maintenance where we reasonably can. We do not promise uninterrupted service, and the software is provided without warranties beyond those that cannot be excluded by law.

Liability

To the fullest extent permitted by law, CDServices, LLC is not liable for indirect or consequential losses, including lost votes, lost donations, or lost opportunity. Nothing here limits liability that cannot lawfully be limited.

Ending access

A campaign may stop using the service at any time. We may suspend access for non-payment or for a serious breach of these terms. On termination we will return or delete campaign data on request, as set out in the privacy policy.

Governing law

These terms are governed by the laws of the State of Texas.
